The Site is operated by TrueNorth Marketing ("TrueNorth Marketing," "we," "us," or "our"), based in Oklahoma City, Oklahoma. These Terms apply to all visitors and users of the Site.

2. Our Role

TrueNorth Marketing provides consulting, sales, and referral services related to B2B sales strategy, merchant processing, and point-of-sale (POS) systems. We are not a bank, payment processor, or money transmitter. Merchant accounts are approved and provided by third-party payment processors and their sponsor banks. POS hardware and software are provided by third-party manufacturers and vendors. Any merchant processing, equipment, or software you obtain is governed by the separate agreement you sign with that provider. If those agreements conflict with these Terms, the provider's agreement controls for that service.

3. Use of the Site

You may use the Site for lawful business and informational purposes only. You agree not to:

• Submit false, misleading, or someone else's information
• Attempt to gain unauthorized access to the Site or its systems
• Upload viruses, malware, or other harmful code
• Use automated tools to scrape or collect data from the Site
• Use the Site in any way that violates applicable law

4. Information Only; No Guarantees

Content on the Site is provided for general information. It is not legal, tax, accounting, or financial advice. Any savings estimates, rate comparisons, or proposals we provide are based on the information you give us and current market pricing, and are not a guarantee of future costs or results. Final rates, fees, and approval are determined by the processor or provider.

5. Third-Party Products, Services, and Links

The Site may reference or link to third-party products, services, and websites. We do not control and are not responsible for their content, policies, availability, or performance. Your dealings with any third party are solely between you and that party.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and layout, is owned by or licensed to TrueNorth Marketing and protected by copyright and trademark laws. You may not copy, reproduce, or distribute Site content without our written permission. Third-party names and trademarks belong to their respective owners.

7. Testimonials

Testimonials reflect the individual experiences of real clients. Results vary by business, and testimonials are not a guarantee that you will achieve the same results.

8. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, TrueNorth Marketing and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site or reliance on its content. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless TrueNorth Marketing from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new effective date. Continued use of the Site after changes are posted means you accept them.

13. Email and SMS Program Terms

Email. By submitting your email address through the Site, you agree to receive emails from TrueNorth Marketing related to your inquiry, account, or services. If you sign up for our newsletter, you also agree to receive marketing emails such as updates, offers, and industry news. You can unsubscribe from marketing emails at any time using the link in any email.

SMS / Text Messaging. TrueNorth Marketing Alerts is a text messaging program operated by TrueNorth Marketing. By replying YES to our SMS consent email or texting us to opt in, you agree to receive text messages from TrueNorth Marketing at the mobile number you provided. Messages may include appointment and consultation reminders, follow-ups on your inquiry, account and service notifications, and customer support. We do not send promotional or marketing text messages.

• Consent is not required to purchase. You do not have to agree to receive texts as a condition of buying any product or service.
• Message frequency varies based on your inquiry and account activity.
• Message and data rates may apply. Check your mobile plan for details.
• To opt out, reply STOP to any message. You will receive one confirmation text and no further messages unless you opt in again.
• For help, reply HELP or contact us at sales@truenorthmarketingco.com or 405-981-3552.
• Carriers are not liable for delayed or undelivered messages.
• You must be at least 18 years old and the account holder or authorized user of the mobile number you provide. If you change or give up that number, please notify us.

Part 2 – Privacy Policy

TrueNorth Marketing respects your privacy. This policy explains what information we collect, how we use it, and the choices you have.

1. Information We Collect

Information you provide:

• Contact forms: your name, email address, phone number, and message
• Newsletter signup: your email address and, if provided, your name
• Consultations and statement reviews: business name, contact details, and merchant processing statements or other business documents you choose to share
• Applications: if you apply for merchant processing or POS services, business and owner information required by the processor or provider

Information collected automatically: When you visit the Site, our website platform and analytics tools may collect your IP address, browser type, device information, pages visited, and referring website through cookies and similar technologies.

2. How We Use Your Information

• Respond to your inquiries and provide quotes, proposals, and statement reviews
• Help you apply for and set up merchant processing, POS, or other services you request
• Provide ongoing customer support
• Send newsletters and business updates you've signed up for
• Operate, secure, and improve the Site
• Comply with legal obligations

3. How We Share Your Information

We do not sell your personal information. We share it only:

• With processors, banks, and vendors when you ask us to apply for or set up a service on your behalf
• With service providers who help us run our business, such as our website host, email marketing platform, and CRM, who may use it only to provide services to us
• For legal reasons, when required by law or to protect our rights, our clients, or others
• In a business transfer, such as a merger or sale of the business

SMS exception: Mobile phone numbers, text messaging opt-in data, and SMS consent are excluded from all of the sharing categories above. We will never share or sell this information to third parties or affiliates for their marketing or promotional purposes.

4. Merchant Statements and Sensitive Data

Statements and application documents are used only to evaluate and provide the services you request. Please do not send full credit card numbers, bank passwords, or Social Security numbers by regular email. If an application requires sensitive information, we will provide a secure method to submit it.

5. Email and SMS Communications

Email. We use your email address to respond to inquiries, send proposals and service updates, and, if you subscribe, send our newsletter and marketing emails. Our emails may use standard tracking technology to tell us whether a message was opened or a link was clicked, which helps us improve our communications. Every marketing email includes our mailing address and an unsubscribe link, and we honor unsubscribe requests within 10 business days. Even after you unsubscribe from marketing, we may still send transactional emails about an active inquiry or account.

SMS / Text Messages. If you provide your mobile number and consent to receive texts, we use it only to send the messages described in our Email and SMS Program Terms (Part 1, Section 13), such as reminders, follow-ups, account notifications, and customer support. We keep a record of your consent, including the date, time, and method of opt-in.

• No sharing of mobile information: We do not share, sell, rent, or trade mobile phone numbers, text messaging opt-in data, or SMS consent with any third parties or affiliates for marketing or promotional purposes. This information may be shared only with the messaging service providers that deliver our texts on our behalf.
• Opt out anytime: Reply STOP to any text to stop receiving messages. Reply HELP for help.
• Rates: Message and data rates may apply. Message frequency varies.

Phone calls. If you give us your phone number on a contact form, we may call you about your inquiry. You can ask us at any time to stop calling you.

6. Cookies

The Site uses cookies to function properly and to understand how visitors use it. You can block or delete cookies in your browser settings, though some features may not work as intended.

7. Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

8. Data Retention

We keep personal information only as long as needed for the purposes described here, to maintain business records, and to meet legal requirements. Then we delete or securely dispose of it.

9. Your Choices and Rights

You may ask us to access, correct, or delete the personal information we hold about you by contacting us below. Depending on where you live, you may have additional privacy rights under state law, and we will honor requests as required by applicable law.

10. Children's Privacy

The Site is intended for businesses and is not directed to children under 13. We do not knowingly collect personal information from children.
